Representative Matters
Dayna successfully defended an employer at the Colorado Department of Labor concerning classification of an employee as exempt obtaining a finding for the employer and dismissal of the wage complaint.

Dayna has assisted numerous clients with advice’s about non-compete agreements and successfully resolved a difficult non-compete case with counter claims on behalf of her client

Dayna successfully defended a religious university client against claims of invasion of privacy and violation of Colorado’s Legal Off-Duty Activities statute in a Denver District Court trial.

Dayna resolved (for a nominal amount) a Fair Labor Standards Act case brought against an employer by the United States Department of Labor; the potential amount of damages were in the high six figures.

Dayna defended a grocer in the appeals process of the Colorado Civil Rights Division Commission, successfully obtaining an affirmation of a no probable cause decision after preparing responses to the charging party’s appeal from the Director’s decision.

Previous Experience

Prior to joining the firm, Dayna worked at an employment and professional liability defense firm, representing clients in an array of employment-related matters that included counseling regarding Department of Labor investigations, employment handbooks, employee disciplinary actions, and lay-offs, along with litigating cases alleging violations of the Family Medical Leave Act, violations of the Fair Labor Standards Act, violations of Colorado’s Legal Off-Duty Activities Statute, and discrimination on the bases of age, gender, race, disability, sexual orientation, and national origin.  She also has experience working in private practice at a general civil litigation firm where she represented plaintiff clients in litigation matters in state and federal courts and before the Colorado State Personnel Board.

Prior to working in private practice, Dayna served as a law clerk for Honorable R. Brooke Jackson.
